There are interesting similarities between the Code of Hammurabi and the case laws given in Exodus, Leviticus, and Deuteronomy. But there is a sharp contrast between the Code of Hammurabi and the Commandments. The Ten Commandments are apodictic law, whereas the Code of Hammurabi is casuistic law. What we meant by that description is that the Code of Hammurabi is case law, written in the style of “when . . . , if . . ., ”whereas the Ten Commandments are stated in “short, positive declaratory sentences”.
